Indymae, LLC ("Indymae") offers financial services for small businesses through various loan and funding products (the "Service"). Indymae is not a lender, investment advisor, or financial planner, and does not provide legal, tax, or investment advice. Before making any financial decision, consult with your accountant, attorney, or financial advisor.
Use of the Service does not guarantee loan approval. Products such as the Flex Line of Credit or Term Loan are issued through Indymae banking partners and may be subject to separate terms.

Privacy, Personal and Company Information
By using the Service, you agree to Indymae Privacy Policy, which outlines how we collect, use, and protect your personal and business data. From time to time, we may share your information with banking partners or third-party providers to facilitate services. Each third party's privacy policy will be made available to you at the time of application.

Credit Authorization
You certify that you are authorized to apply for credit on behalf of the business, and that all submitted information is accurate and complete. You authorize Indymae, its agents, and partners to obtain consumer and business credit reports, conduct background checks, and verify submitted information.
By agreeing to these terms, you provide 'written instructions' under the Fair Credit Reporting Act for Indymae to access your credit profile for purposes of evaluating your creditworthiness. This is a soft credit inquiry and does not affect your credit score.
You acknowledge you may be personally liable as a guarantor for credit extended to your business.

Consent to Referral
You authorize Indymae to refer your application and share your information with third-party lenders and service providers. Indymae may receive referral compensation, which may influence which providers you are introduced to. Indymae does not act as a fiduciary in these arrangements. Review all loan terms carefully before accepting any offers.

E-Sign Consent
Your electronic signature has the same legal effect as a handwritten signature. You agree that electronically signed agreements and documents are valid and enforceable. All disclosures, notices, and agreements may be delivered to you electronically.
You also consent to receive communications via email or other digital methods. These communications are legally binding and considered 'in writing.' You may request paper versions of any document at no charge by contacting us.

By using our services, you agree to allow Indymae to retrieve financial and business data from third-party sources (e.g., your bank or authorized platforms) to support your application. This includes granting Indymae access to such sources via credentials or direct uploads.

Identity Verification
To comply with federal regulations and combat fraud and money laundering, Indymae collects identifying information such as your name, address, and government-issued ID. This data is used to verify identity and evaluate eligibility for financial services.

Telephone Communications
You consent to receive calls and messages from Indymae, including pre-recorded messages and SMS, at the phone numbers you provide. These may be made by automated systems and may be recorded for quality and compliance. You may opt out of marketing communications at any time.

Jurisdiction
These Registration Terms are governed by the laws of the State of Florida without regard to conflict of law principles.

If you are married, you may apply for credit in your name alone.

Arbitration Clause
Any dispute arising from these terms or the use of our services will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or class action lawsuit.
